On the application of Sergeant Stephens the charges were remanded to Frankston today. Bail was fixed at £200 on each charge. On the bench with Mr. E. Knight, P M, were Messrs T. O'Callaghan, W. A. FRANKSTON SHOOTING CASE.

PETER HANNAH SENTENCED.

Two Years' Imprisonment.

Before Mr. Justice Macfarlan in the Criminal Court yesterday Peter Gordon Hannah, who had been found guilty of having unlawfully wounded Senior constable Culhane at Frankston on November 17, was arraigned for sentence.

Mr Gorman on behalf of Hannah, said that the prisoner had had 15 years' service as a constable. He had been presented on three counts, two of which implied intent and the third, which did not suggest intent. The verdict of guilty on the third count was probably due to the fact that the Crown had put it to the jury that intent did not enter into consideration.

Mr Justice Macfarlan said that Hannah was fortunate in not being found guilty on a more serious charge. Mr Justice Micfarlan, however, could not disregard the finding of the jury, which apparently thought that the prisoner did not shoot with intent to murder or with intent to wound. At the same time it was impossible to shut one's eyes to the fact that it was a most serious offence. He would take into consideration the fact that the prisoner was undoubtedly drunk at the time. The maximum statutory sentence prescribed was three years' imprisonment, and in the circumstances it would not be right to impose a sentence of less than two years' imprisonment with hard labour. That sentence Hannah would have to undergo.

Note1957Ensign Stewart (Stu) Hannah died in an aircraft accident on 11 Sept 1957 during the latter stages of his pilot training at NAS Memphis, TN. Besides his parents, he left a sister, Emily, who later became Chancellor of the University of Wisconsin. Stu was from Denver, CO and would never let you forget what a wonderful place it was. He thrived there amidst all of its offerings, including high school academics. He won a scholarship to Princeton but opted for the Naval Academy. He continued his track record at USNA and developed a bundle of friends along the way, in no small part due to his courtly manner and intense interest in all people. Stu’s interests, beyond academics, included tennis, battalion sports, and the drag circuit. His dates always received a tour and explanation of the Academy. He was well on his way to marriage when fate stepped in.

An absolute delight to Stu was the winning of the Color Company award by the 18th Company in 1955. This would soon have ramifications for the Academy. Following his death, Stu’s parents contacted a classmate whom they had known. The result was the "Stewart Wight Hannah Trophy" which is a silver bowl inscribed with the spring-set color company commander's name and company. This trophy is displayed in Bancroft Hall. Stu’s penchant for excellence lives on as the 18th company has won the trophy at least five times since Stu’s death.
